GENERAL CONDITIONS OF SALE

The offer of this online store is proposed by the Italian Section of the ESTA with registered office in Piazza Stradivari 5, 26100, Cremona, in accordance with the current regulations for electronic commerce and distance contracts contained in Legislative Decree 206/2005 ("Consumer Code").

By placing an order on the online store available on the site https://estaitalia.it/ (the "Site") The Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

Except for the mandatory limits of the law, any right of the Customer to compensation for damage and / or the recognition of any other form of compensation, as well as any contractual and / or extra-contractual liability for direct or indirect damage to persons and / or things is expressly excluded, caused by the non-acceptance, even partial, of an order. In the event of unexpected unavailability of the ordered product and / or non-acceptance of the order, for any reason, no charge will be made to the Customer.

PRICES AND CHARACTERISTICS OF THE PRODUCTS

Except in cases where it is expressly indicated otherwise, the prices of the products published on the Site are expressed in Euros and must be understood as inclusive of VAT.

The Customer accepts the Seller's right to change his prices at any time; however, the products purchased will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation e-mail sent by the Seller to the Customer.

ORDERS AND BILLING

Each product order sent to the Seller constitutes the Customer's contractual proposal. The fulfillment of the order by the Seller is equivalent to confirmation and acceptance of the same.

To make the purchase, the Customer must fill in, in addition to the mandatory fields, also the Tax Code field.

For the purposes of issuing the invoice, the information provided by the Customer, which he declares and guarantees to be truthful, will prevail, releasing the Seller as broadly as possible in this regard.

ORDER ACCEPTANCE

The conclusion of the contract will take place only upon confirmation of the order by the Seller.

Correct receipt of the order is confirmed by the e-commerce system by means of an e-mail reply, sent to the e-mail address supplied by the Customer.

This confirmation message will contain the date and time of the order and the e-mail entered during the purchase phase, to be used in any further communication. It is the Customer's responsibility to perform the registration necessary for the purchase using correct personal data; likewise, it is his responsibility to keep such data updated.

In the order confirmation e-mail, the Customer will also receive the link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

PAYMENT METHODS ACCEPTED

On the Site it is possible to pay for the order in different ways:

  • Credit card: with this option you can pay with your credit card or rechargeable card. 

The Seller retains the right of ownership of the delivered goods until full payment of the amount indicated in the order confirmation or in the invoice if sent together with the products.

RIGHT OF WITHDRAWAL

In accordance with the provisions of the law in force, the Customer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products.

The Customer who intends to exercise the right of withdrawal must notify the Seller by means of an explicit declaration, which can be sent by sending an email to segreteria@estaitalia.org.

The Seller will refund the amount of the products subject to withdrawal within a maximum period of 14 days from receipt of the products.

The Seller will make the refund using the same payment method chosen by the Customer during the purchase. 

DATA PROTECTION

The data provided will be processed in accordance with the European Regulation on the processing of Personal Data (EU) 2016/679 and the Italian Privacy Code in force (Legislative Decree 196/2003 and subsequent Legislative Decree 101/2018), also in order to allow the access to exclusive benefits, for the sending of commercial information and service communications, for the management of orders and any request from customers.

APPLICABLE LAW AND JURISDICTION

The sales contract between the Customer and the Seller is concluded in Italy and governed by Italian law.

For the solution of civil disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the mandatory territorial jurisdiction is that of the reference forum of his town of residence or domicile, if located in the territory of the State; in all other cases, the territorial jurisdiction is exclusively that of the Milan Court.

Pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the Customer declares to have carefully read and understood and to specifically accept the following clauses of the General Conditions of Sale:

  • prices and characteristics of the products;
  • orders and invoicing;
  • order acceptance;
  • customer obligations;
  • right of withdrawal;
  • applicable law and competent court.
